Cloud Castles: Battlegrounds End User License Agreement
These Terms of Service and End User License Agreement ("Terms") govern your access to, download of, installation of, and play of Cloud Castles: Battlegrounds, including all related services. By accessing or using the Game, you agree to these Terms. If you do not agree, do not access or use the Game.
1. Acceptance of Terms
These Terms form a binding agreement between you and DIG. We may update these Terms at any time. Material changes will be notified via in-game notice, the website, or platform channels. Continued use after the effective date constitutes acceptance. If you do not agree to modified Terms, you must stop using the Game.
2. Eligibility and Age Restrictions
You must be at least 16 years old to use the Game. You represent and warrant that you meet this age requirement and that your platform account (Epic Games Store, Steam) complies with both these Terms and the applicable platform's terms of service. The Game is not directed to or intended for individuals under 16. Use by anyone under 16 is unauthorized and violates these Terms. We may suspend or terminate access if we become aware of such use.
Parents and guardians: If you believe a person under 16 has accessed the Game, contact us immediately at support@digitalinsightgames.com. We will investigate and take appropriate action.
3. Early Access
Cloud Castles: Battlegrounds is released as an Early Access title and remains in active development. As a result, the Game may contain bugs, interruptions, incomplete features, or other issues. Gameplay mechanics, content, balance, progression, and other aspects of the Game may change at any time, and we may reset, modify, or remove player progress, virtual currency, items, or other game data as part of development, testing, updates, or live operations. Your purchase of the Game provides access to its current state and any updates we choose to release.
4. Account and Access
Access to the Game is provided through the Epic Games Store and Steam. You must comply with the terms and policies of the platform through which you access the Game. You are responsible for the security of your platform account and for all activity occurring under it. If unauthorized access affects your use of the Game, you should promptly contact the applicable platform provider and, where relevant, our support.
5. License Grant
Subject to these Terms, DIG grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Game for personal, non-commercial entertainment purposes on supported platforms. This is not a sale. DIG and its licensors retain all ownership and intellectual property rights. We may enforce these Terms through the platforms, and platform enforcement actions are not our responsibility.
6. Virtual Currency and In-Game Items
The Game itself may be purchased through the Epic Games Store or Steam. All payment, billing, and refund matters relating to that purchase are handled by the applicable platform and are subject to that platform's terms, except to the extent mandatory law provides otherwise.
The Game also includes virtual currency and in-game items. At this time, all virtual currency (including shards and diamonds) and in-game items are earned exclusively through gameplay and in-game events. No in-game currency, in-game items, or downloadable content are sold for real-world money through the Game at this time.
Virtual currency may be used for in-game features such as creature summons, which involve randomized outcomes. The specific mechanics, rewards, availability, and operation of these features may change over time.
All virtual currency and in-game items are licensed, not owned. They have no cash or real-world value, are not redeemable for money, and may not be transferred, sold, shared, or exchanged except as expressly permitted by us. We may modify, rebalance, add, or remove virtual currency, in-game items, or related features at any time as part of updates, balancing, maintenance, or operation of the Game.
We may expire unused virtual currency after 24 months of account inactivity, where permitted by applicable law. We may also remove virtual currency or in-game items from an account if they were obtained through fraud, exploitation, or other violation of these Terms, or if the account is suspended or terminated under these Terms, in each case without compensation except where required by law.
Certain jurisdictions may impose additional rules or restrictions on randomized in-game features. We reserve the right to modify, limit, or disable such features in those jurisdictions.
7. Gameplay and User Conduct
You agree not to:
- Cheat, hack, use bots, exploits, unauthorized software, or any means to gain unfair advantage.
- Harass, threaten, abuse, or disrupt other players.
- Exploit game systems, mechanics, or bugs, including collusive play such as deliberate win/loss arrangements to rapidly gain experience or rewards, or exploiting bugs without reporting them.
- Share, sell, or transfer accounts.
- Create alternate accounts ("smurfing") to manipulate matchmaking or rankings.
- Use the Game commercially or for any unauthorized purpose.
DIG may monitor usage and take action, including bans or termination, for violations.
8. User Content and Communications
The Game currently has no text or voice chat, messaging, persistent communication features, or user-generated content. If any such features are added in the future, any user-generated content or communications must comply with these Terms. You grant DIG a worldwide, royalty-free license to use it for operating, improving, and promoting the Game. We may moderate or remove content at our discretion.
9. Ownership and Intellectual Property
All Game content is owned by DIG or its licensors. You acquire no ownership rights in the Game or any part of it, and, except as expressly permitted by these Terms or applicable law, you may not copy, modify, distribute, sell, sublicense, rent, lease, lend, transfer, reverse-engineer, decompile, disassemble, or create derivative works from the Game.
10. Service Changes and Availability
The Game is a live-service title. DIG may, at any time and without liability, except where law requires refunds, modify, update, rebalance, suspend, discontinue, or remove any features, content, servers, or the Game itself, including progress resets or currency or item adjustments. Where reasonably practicable, we may provide advance notice for major changes.
11. Termination
We may terminate or suspend access at any time for violations, at our sole discretion. Upon termination, your license and access to virtual currency and items end. You acknowledge that termination results in forfeiture of all virtual currency and items with no refund right, except where prohibited by law.
12. Disclaimers and Limitation of Liability
The Game is provided "as is" without warranties. DIG does not guarantee uninterrupted access, bug-free operation, or compatibility with all hardware or software. To the maximum extent permitted by law, DIG's total liability shall not exceed the greater of US$100 or the amount paid by you for the Game during the preceding 12 months.
DIG is not liable for indirect, consequential, or punitive damages. Nothing in these Terms excludes or limits liability where prohibited by applicable law. EU and UK users retain statutory consumer rights.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of California, without regard to conflict of laws principles.
Except where applicable law provides otherwise, any dispute, claim, or controversy arising out of or relating to these Terms or the Game shall be brought exclusively in the state or federal courts located in Los Angeles County, California. You and DIG consent to the personal jurisdiction of those courts for such disputes.
To the extent permitted by law, all disputes must be brought on an individual basis only, and not as part of any class action, collective action, consolidated action, coordinated action, or representative proceeding. You waive any right to participate as a plaintiff or class member in any such proceeding against DIG.
Nothing in this section limits any non-waivable consumer rights you may have under applicable law, including any right to bring a claim in another forum where such a right cannot lawfully be excluded.

15. Miscellaneous
These Terms and our Privacy Policy govern your relationship with DIG. Your use of the Game through a platform is also subject to that platform's terms. If any provision is invalid, the remainder remains effective. No waiver of one breach waives others.
